Terms of Service

Last updated October 15, 2026

1. About these terms

These terms are an agreement between you and Ertugrul Ozyilmaz, doing business as evim.ca ("evim.ca", "we", "us"). They apply when you create an account on evim.ca, build or publish a website with it, or pay for a plan. By creating an account you agree to them. If you don't agree, don't use evim.ca.

2. The service

evim.ca lets a licensed real estate agent build, preview and publish a personal website: a profile, listings, services, testimonials, a lead form and contact details, at a yourname.evim.ca address or on a domain the agent owns. Building and previewing are free. Publishing needs an active plan, unless we have agreed otherwise with you in writing.

3. Who may use evim.ca

You may use evim.ca only if you are an individual registered with a real estate regulator in a region we support (today: Ontario, with the Real Estate Council of Ontario, RECO), and only for your own real estate business. You must be at least the age of majority where you live. One account is for one person; don't share your sign-in.

4. Registration checks

Before a site can be published, we check the name, registration number, category and brokerage you give us against the regulator's public register. We may ask for a change, refuse a site, or pause a published site if we can't confirm your registration, if the register shows that your registration has ended or been suspended, or if you change your registration details in a way we can't confirm. A check is not legal advice and does not make us responsible for your compliance.

5. Your responsibilities

You are responsible for everything you publish, as with any advertising. In particular:

  • You follow the advertising rules of your regulator and your brokerage, including showing your registered name, title and brokerage as required. evim.ca shows these details on every page, but you must keep them accurate.
  • What you publish is true and current: prices, property details, availability, your experience and your services.
  • You have the seller's or landlord's consent, and your brokerage's, before you show a sold or leased property, and you choose whether its price may be shown.
  • You have each client's permission before you publish their testimonial with their name.
  • You own the photos and text you upload, or have the right to use them, including listing photos taken by others.
  • You reply to the people who contact you through your site, and you handle their personal information as the privacy laws that apply to you require.

6. Acceptable use

You agree to our Acceptable Use Policy. We may remove content or pause a site that breaks it.

7. Your content

You keep all rights to the content you upload. You give us a non-exclusive, worldwide, royalty-free licence to host, copy, resize, display and send your content only as needed to run evim.ca for you: to show your site, to send emails you trigger, to make backups and to provide support. This licence ends when your content is deleted, except for copies in backups, which are deleted on their normal schedule.

8. Plans, billing and Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Prices are shown in Canadian dollars and do not include taxes; Paddle adds the sales tax that applies to you and sends your receipts. Plans renew automatically at the end of each monthly or yearly period until you cancel. Paddle's buyer terms also apply to your purchase.

9. Price changes

Every subscription keeps the price it started with for as long as you keep your plan (our founding price). If we ever need to change the price of an existing plan, we will tell you by email at least 30 days before the change applies, and you may cancel before then.

10. Cancelling

You can cancel at any time in Settings, Plan and billing. Your site stays live until the end of the period you paid for, and then it is paused. We keep your content for 90 days after your plan ends so you can publish again and pick up where you left off; after that we may delete it. You can download a copy of your data at any time from Settings, Account.

11. Money-back guarantee

If you are not happy, ask for a refund of your first payment within 30 days of it, from Settings, Plan and billing or by email to support@evim.ca. We refund the first payment in full and end your plan, and your site is paused. See our Refund Policy.

12. Messages from your site's visitors

When a visitor sends a message through your site, we process their information on your behalf, only to provide evim.ca to you: we store the message, show it in your dashboard and email it to you. We do not sell it, we do not use it to train artificial intelligence models, and we share it only with the service providers named in our Privacy Policy. We protect it with reasonable security safeguards. If a breach of our security affects your visitors' information, we will tell you within 72 hours of discovering it, so that you can meet your own obligations.

13. Suspension and ending

We may pause or suspend your site, or close your account, if you break these terms, if we can't confirm your registration, if a payment fails and is not fixed within the grace period, or if we must do so by law. Where it is reasonable, we will tell you why and give you a chance to fix the problem first. You may delete your account at any time from Settings, Account.

14. Availability and changes

We work to keep evim.ca available and secure, but we don't promise that it will always be available or free of errors. We may change or improve features. If we remove a feature you pay for in a way that matters to you, we will tell you first, and you may cancel before your next payment.

15. Disclaimers

evim.ca is provided "as is". To the extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose. We are not a brokerage and do not give legal, regulatory or real estate advice.

16. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim about evim.ca is limited to the fees you paid us in the 12 months before the claim.

17. Indemnity

You will compensate us for claims, losses and reasonable legal costs caused by content you published or by your breach of these terms or of the law.

18. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction, unless the law where you live gives you a right to go to your local courts.

19. Changes to these terms

We may update these terms. If a change matters to you, we will email you at least 30 days before it takes effect. The date at the top of this page shows when they last changed.

20. Contact
