Terms of Service

1. Agreement
These terms are a contract between THEKEY4YOU INC. ("we", "us", "evim.ca") and the real estate agent, team, or brokerage that creates an account ("you", "Agent"). By creating an account, you agree to these terms.
evim.ca is a business tool for licensed real estate professionals. It is not intended for personal or consumer use.
2. The service
evim.ca gives you a professional website on a subdomain (yourname.evim.ca) or on a custom domain you connect. You can add your biography, photos, brokerage information, property listings, and client testimonials, and receive inquiries through a contact form.
3. Eligibility
You must be a real estate agent, team, or brokerage registered with the Real Estate Council of Ontario (RECO). You are responsible for keeping your registration in good standing and for telling us promptly if it lapses or is suspended.
4. Fees and billing
- Single agent plans: CAD 39 per month or CAD 390 per year.
- Team and brokerage plans: priced and invoiced individually, as agreed with you.
- Payments are processed by Stripe. We do not store your full card details.
- Annual plans: full refund if you cancel within 14 days of purchase.
- Monthly plans: not refundable. If you cancel, your site stays live until the end of the period you already paid for.
- Setup fees on team and brokerage plans are not refundable.
- We will give you at least 30 days' notice before any price increase takes effect on your account.
5. Your content
You own the content you upload, including photos, biography, listings, and testimonials. We do not claim ownership of it.
You give us a licence to host, store, and display your content as part of operating your website. This licence ends when the content is removed or your account is deleted, except for copies kept in routine backups until they are cycled out.
6. Your responsibilities
You are responsible for:
- The accuracy of everything on your site, including listings, prices, and sold data.
- Making sure your brokerage is clearly and prominently identified on your site, as required by RECO Bulletin 5.3, since your site is treated as a brokerage website.
- Updating your brokerage information on your site promptly if you change brokerage.
- Holding all necessary consents before you upload photos, names, testimonials, or sold price information involving buyers or sellers.
- The lawfulness of collecting personal information through your site's contact form, including telling visitors how that information will be used.
- Complying with RECO's rules and all other laws that apply to your advertising and real estate activity.
We will act on requests to edit or take down content promptly, including requests from anyone whose photo, name, testimonial, or sold price data appears on your site without their consent.
7. Indemnity
You agree to defend and indemnify us against claims, losses, and costs arising from: your content, your use of contact form data, or your breach of RECO's rules or other laws that apply to your advertising or your practice. This includes claims brought by members of the public whose information you collect through your site.
8. Data handling
Personal information passes through our systems and the following service providers when you use evim.ca, including contact form submissions from your site's visitors:
- Stripe – payments
- Resend – email
- Supabase – database, authentication, file storage
- Vercel – hosting
Some of these providers process information outside Canada. We remain accountable for this information under Canadian privacy law and require our service providers to protect it accordingly.
If a breach of security safeguards creates a real risk of significant harm, we will notify affected individuals and report it to the Office of the Privacy Commissioner of Canada, and we keep an internal breach log for at least 24 months.
Automated emails that encourage a paid action, such as notices about photo storage on unpublished accounts, will identify us as the sender and include a working way to unsubscribe, as required by Canada's Anti-Spam Legislation (CASL). Password reset emails and payment receipts are not affected by this requirement.

9. Suspension and termination
We can suspend or terminate your account if you materially breach these terms, including RECO non-compliance, non-payment, or unlawful use of contact form data.
Unpaid but not cancelled. If your payment lapses but you have not cancelled your account, we take your site offline and show a page saying the site is temporarily unavailable, instead of returning an error or a blank page. We do not delete your data. Your site comes back online automatically once payment resumes.
You can cancel at any time. Cancellation takes effect as described in Section 4. When your account is cancelled, your site goes offline. We retain your data rather than deleting it, in case you reactivate, unless you ask us to delete it and we are not required to keep it.
10. Disclaimers
We provide evim.ca "as is." We do not guarantee the service will be uninterrupted or error-free. We are not responsible for the accuracy of listings, testimonials, or other content you provide, or for your compliance with RECO's rules or any other law.
11. Limitation of liability
Except for claims arising from fraud, wilful misconduct, or gross negligence, our total liability to you under these terms is capped at the fees you paid us in the twelve months before the claim arose. Neither of us is liable to the other for indirect, incidental, or consequential damages.
12. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply in Ontario.
13. Changes to these terms
We can update these terms from time to time. If a change is material, we will email you at least 30 days before it takes effect, and post the updated version here with a new "last updated" date.
If you do not accept a material change, you can cancel your account before it takes effect. We will refund you a pro rata amount for any prepaid period you have not yet used.
Continued use of the service after a material change takes effect means you accept it. Minor changes, such as fixing errors or clarifying wording, can take effect immediately without notice.
